BOISE, Idaho (CBS2) — Three former Idaho attorneys general, two democrats and one republican filed a brief with the ninth circuit court of appeals Monday.
According to the American Civil Liberties of Idaho, the brief explains why Idaho's house bill 500, which bans transgender women and girls from participating in school sports, is unconstitutional. The bill would alsosubject Idaho's women and girl athletes to invasive testing.
Jim Jones, Wayne Leroy Kidwell, and W. Anthony Park are urging the court to uphold the Idaho federal district court’s injunction, which would bar the enforcement of House Bill 500.
“Most upsetting, however, is the message that the Act has sent to Idaho’s transgender citizens and their families, friends, and allies,” the former attorneys general state in the brief. “In purporting to level the playing field, the Act has excluded an entire group of women from meaningful participation in sports.”
Although the brief filed is one of many friend-of-the-court briefs filed opposing the bill, this is the first time the three former attorneys general, two republicans and one democrat, have filed one.
Over 60 women’s rights and civil rights groups,including the Idaho Coalition Against Sexual and Domestic Violence, as well as businesses such as NikeAmalgamated Bank, and Altria Group also filed briefs.
